JOHN CHAPMAN of Headlam in the County of Durham Gentleman made this sixth day of March in the year of our Lord one thousand eight hundred and forty seven I give and bequeath all the money Bank of England and County Bank Notes plate plated Articles linen china Beds bedding household goods and furniture wines liquors fuel housekeeping stores and provisions and other moveable effects of the like nature and all the Horses Cows Carts Carriages live and dead stock and implements of husbandry of every description which shall be in or about my dwelling house farm and premises wheresoever I shall be residing at the time of my decease and which shall be my property unto my daughter MARY CHAPMAN her Executors Administrators and assigns I give and devise unto John Lamb of Barnard Castle in the County of Durham Gentleman James Rawe of Piercebridge Grange in the said county Farmer and John Lawson late of East Wood in the County of York but now of Barnard Castle aforesaid Land Surveyor their heirs and assigns All that my Water Corn Mill situate and being at Alwent in the Parish of Gainford in the said County of Durham commonly called or known by the name of Alwent Mill and all the Machinery within or belonging to or used with the same together with the Dams Cloughs races watercourses and other appendages and appurtenances thereto and all the Dwellinghouse Kiln House Stable and all other buildings and belonging or attached thereto with their appurtenances To hold the same unto and to the use of the said John Lamb James Raw and John Lawson their heirs and assigns Upon the Trusts and subject to the provisions hereinafter contained (that is to say Upon Trust to pay the rents issues and profits thereof unot or permit the same to be reveived by my said daughter Mary Chapman and of her assigns for and during the term of her natural life for which payments the receipt of the said Mary Chapman or her assigns notwithstanding coverture shall be a sufficient discharge to the intent that the same may be for her sole and separate use and may not be subject to the control or engagements of any person with whom she may intermarry and from and after the decease of the said Mary Chapman the said hereditaments and premises devised in trust as aforesaid shall be upon Trust for such one or more weither inclusive or exclusive of the other or others of the children or more remote issue of the said Mary Chapman for such Estates and in such shares and manner and with such provisions for maintenance and education during minority and other provisions and limitations as the said Mary Chapman whether covert or sole and notwithstanding coverture if she be married shall by any deed or deeds revocable or irrevocable to be by her duly executed or by her last Will and Testament in writing from time to time or at any time appoint and in default of such appointment and so far as any such appointment may not extend Upon Trust for all and every child or children of my said Daughter Mary Chapman who being a son or sons shall attain the age of twenty and one years or being a Daughter or Daughters shall attain that age or marry his her and their heirs and assigns for ever if more than one as tenants in common I declare that it shall be lawful for the said Mary Chapman if she think fit in exercising the said hereditament to any persons in Trust for sale and for application of the monies arising therefrom unto or for the benefit of any object or objects of the said power and to authorize such trustees for sale or any of them to discharge the purchaser or puchasers from all responsibility respecting the application of the purchase money provided always and I hereby declare that no child of my said Daughter who shall take any part or share in the said hereditament herinfore devised under or by virtue of any appointment to be made thereof as aforesaid shall be entitled (unless such appointment shall expressly so direct) to share with the other child or children in any unappointed part share or interest thereof or therein unless such child or children respectively shall bring his her or their appointed share or shares into Hotch potch or distribution with the other child or children of may said Daughter and in case my said Daughter Mary Chapman shall have no child sho shall survive me and who shall attain the age of twenty one years or marry then the said hereditaments and premises devised in trust as aforesaid shall thenceforth remain and be upon and for the same uses trusts intents and purposes and subject to the same charges and provisions as hereinafter are declared or contained concerning my farm at Alwent I give and devise unto and to the use of the said John Lamb James Raw and John Lawson their heirs and assigns All my farm of land at Alwent aforesaid consisting of three messuages or Dwellinghouses with the barns stables cowhouses cattlehouses (she---??) fold yards and other buildings thereto belonging or therewith enjoyed one hundred and ninety acres of land or thereabouts with their and every of their appurtenances (at the time of making this my will in the occupation of William and Hodgson Emmerson but which I intend to take into my own hands and reside upon at and from May day next) Upon the trusts and subject to the provisions following (that is to say) Upon Trust to permit and suffer my said Daughter Mary Chapman to occupy use and enjoy the said Messuages farm and premises for the space of eight years next after my decease and to employ my Grandson WILLIAM CHAPMAN to assist her in conducting the same and I will and direct that for such assistance my said Daughter shall pay unto my said Grandson the some of thirty pounds per annum during the said term of eight years and at the expiration of the siad term of eight years from my decease I will and direct that my said Daughter shall relinquish the said Messuages farm and premises so lastly devised in trust as aforesaid in favor of my said Grandson William Chapman and shall deliver to him at the same time for his own use the stock of Horses cattle and farming Utensils thereon or shall provide and deliver to my said Grandson such quantity of stock and farming implements as it may have been usual upon an average to keep upon the said farm and from and after the expiration of the said term of eight years as aforesaid I direct that the said Trustees or Trustee for the time being shall stand seized and interested in the said messuages farm of land and premises at Alwent so lastly devised to them in trust as aforesaid Upon Trust for my said Grandson William Chapman for and during the term of his natural life and after his death Upon Trust for all and every the child or children of the said William Chapman who being a son or sons shall live to attain the age of twenty one years or being a Daughter or Daughteers shall attain that age or marry his her or their heirs and assigns as tenants in common if more than one and if but one then in Trust for such only child and if there be no child of my said Grandson William Chapman who being a son shall live to attain the age of twenty and one years or being a Daughter shall attain that age or marry then the said last mentioned Messuages farm of land and premises shall be in Trust for my Grandson JOSEPH CHAPMAN Brother of the said William for and during the term of the natural life of my said Grandson Joseph Chapman and from and after the death of the said Joseph Chapman in trust for all and every child and children of the said Joseph Chapman who being a son or sons shall attain the age of twenty one years or being a Daughter or Daughters shall attain that age or marry his her or their heirs and assigns as tenants in common if more than one and if only one then to such only shild but if there shall be no son of my said Grandson Joseph Chapman who shall attain the age of twenty one years or no daughter who shall attain that age or marry then the said Messuages farm of land and premises last mentioned shall be In trust for my Grandaughter MARGARET CHAPMAN sister of the said Joseph Chapman her heirs and assigns for ever I give and devise to my said Daughter Mary Chapman in addition to the other devises and bequests herein contained for her benefit one annuity or clear yearly sum of One hundred pounds to commence at the end of eight years from my death and continue to be payable thenceforth by equal half yearly payments at May day and Martinmas every year during the natural life of the said Mary Chapman I also give and devise unto each of the sons and Daughters of my sons JOHN ROBINSON CHAPMAN and GEORGE CHAPMAN an annuity of ten Pounds to commence and be payable to each of them as aforesaid at the end of six calendar months from and after the decease of my daughter Mary Chapman and continue to be paid to them thenceforth by even and equal half yearly payments I also give and devise to each of my three sons John Robinson Chapman and William Chapman during his natural life an Annuity or clear yearly sum of Fifty Pounds to be payable to each of them as aforesaid by even and equal half yearly payments the first half yearly payment to be made at the end of six calendar months from my decease I also give and devise unto each of the three sons of my said son George Chapman who may be under the age of twenty one years the sum of ten Pounds per annum unti he reaches such last mentioned ago to be applied by the said Trustees or Trustee towards his maintenance and education I charge also the said annuities given by this my Will upon my farm at Alwent and the lands and hereditaments hereinbefore devised therewith and I give to every annuitant the like remidies for recovering his or her annuity as landlords by law have for recovering rent from their yearly tenants I direct that is the said farm at Alwent and premises so charged with the said Annuities should from fire change of times or other causes by insufficient to meet and pay the said Annuities then the same shall abate in proportion to the diminished value of such farm and premises such proportions and diminutions to be ascertained and settled by the Trustees or Trustee for the time being under this my Will or by whom they the said Trustees or Trustee may appoint I authorize the Trustees or Trustee for the time being under this my Will subject nevertheless to the life interests and annuities given by thias my Will to apply all or any part of the yearly income of the share or prospective or contingent share or interest of any infant devisee under this my Will towards the maintenance or education or otherwise for the benefit of such infant during his or her minority I empower my said Daughter Mary Chapman during her life at any time or from time to time to grant a lease of the said Mill at Alwent and the lands and other premises devised therewith for any term not exceeding fourteen years I also empower the person or persons who for the time being may be tenant or tenants for life of the said farm at Alwent and of other the (sic; the other) lands and premises hereinbefore devised therewith to lease the said last mentioned farm and premises with the consent of the Trustees or Trustee for the time being under this my Will for any term not exceeding fourteen years I also empower the said Trustees or Trustee at any time whilst any of the person or persons entitled to any part of my Estates shall be in minority and there shall be no tenant for life competent to do so to grant Leases from time to time of any part of my estates for any term not exceeding fourteen years I direct that every lease by this my Will empowered to be granted shall be at the best rent or rents which can be reasonably had and without taking any fine or premium I direct the Trustees or Trustee for the time being under this my Will to insure and keep insured from loss or damage by fire in some public Insurance Office to be approved by the said Trustees or Trustee the said Mill and other premises devised herewith and thje Machinery therein until the same under the limitations and devises herein contained shall come into the possession of some person or persons of full age who shall under and by virtue of this my Will be entitled to the absolute fee-simple thereof and in case the same or any part thereof be destroyed or injured by fire then to apply the monies received from such insurance Office in rebuilding and refitting the said destroyed or injured premises I empower the said trustees or trustee to charge the monies to be paid by them in and about effecting and keeping on foot such Insurance to my said Daughter Mary Chapman or tother person or persons who may then for a life or other limited interest be the owner of the said Mill and premises and if the same be not paid at the end of ten days after the same shall have been demanded then to enter such premises and to receive the rents and profits thereof unti such monies and all arrears thereof by paid to them and so to do from time to time as often as there shall be occasion I give and devise all Estates vested in me by way of Mortgage or upon any trusts to the said John Lamb James Raw and John Lawson their heirs Executors Administrators and assigns according to the nature and tenure thereof respectively subject to the Trusts for each other nor for losses happening without their or his wilful default And that they shall and may reimburse themselves and each other all loss costs damages and expences to be by them sustained in or about the execution of the trusts and provisions of this my Will and that any Trustee for the time being of this my Will who may be ab Attorney or Solicitor shall be entitled to make the same fair and reasonable charges for professional business transacted for the Trust estate as he would have been entitled to had he been retained and had not been such Trustee I appoint the said John Lamb James Raw and John Lawson and the said Mary Chapman Executors and Executrix of this my Will and I revoke all former wills by me made and declare this only to be my last Will and Testament In THIS WILL was proved at Durham on the 18th day of April 1849 by John Lamb of Barnard Castle in the County of Durham Gentleman James Raw of Piercebridge Grange in the same county Farmer John Lawson late of Eastwood in the County of York but now of Barnard Castle in the same county of Durham Land Surveyor and Mary Chapman of Alwent in the Parish of Gainford in the County of Durham aforesaid Spinster the executors therein named to whom administration was granted they having been first duly sworn before The Reverend George Dugard, Clerk, Master of Arts our Surrogate lawfully appointed faithfully to execute and perform the same as usual and that the Testator died on the 20th.day of February 1849.
